The designation states that the assets owned by CUPET “were illegally expropriated from U.S. owners years ago.” Some of these properties are currently the subject of litigation in U.S. courts under the Helms-Burton Act. The sanction against the company is based on Executive Order 14404 issued by Donald Trump on May 1, 2026. “CUPET is being designated pursuant to Section 2(a)(i)(A) of Executive Order 14404, for operating or having operated in the energy sector of the Cuban economy.” Furthermore, the decision is based on the declaration of a national emergency regarding Cuba, issued by Trump in late January, and Presidential National Security Memorandum 5, “which direct the Executive Branch to improve human rights, foster the rule of law, free markets, and free enterprise, and promote democracy in Cuba,” the statement notes. The sanctions mean that all CUPET assets and interests in the United States or “in the possession or control of U.S. persons are blocked” and must be reported to OFAC. “In addition, all entities that are owned, individually or collectively, 50 percent or more by one or more blocked persons are also blocked,” he adds.
