Peñarol suffered a setback from the Appeals Committee, which dismissed the club’s appeal seeking a reduction in the penalty imposed following the incidents that occurred after the derby at the Campeón del Siglo Stadium. The Disciplinary Commission had sanctioned the Mirasol club with the deduction of one point (under Article 5.9.1 of the Disciplinary Code), a ban on playing at the CDS, the requirement to play four home games behind closed doors, and a fine of 150 Adjustable Units (UR). Despite Mirasol’s attempts to reduce the penalty, the appellate court dismissed the appeal. “The appeal filed by Club Atlético Peñarol is hereby dismissed, and therefore, the ruling of the Disciplinary Commission dated September 9, 2026, is upheld in its entirety, with no right to a refund of the appeal fee paid,” the Appeals Court stated in its ruling, which was obtained by Ovación. Furthermore, the court held that “the violence observed cannot be normalized, downplayed, or incorporated as just another component of the sporting event.” The appellate court holds that through a “dispassionate review of the video footage,” one can “recognize the extreme gravity of what occurred and agree that any sporting sanction imposed in response to events of this nature runs the risk of appearing insufficient given the severity of the established facts.” Напомним, что Дисциплинарная комиссия применила статью 5.9.1 Дисциплинарного кодекса для снятия одного балла.
